In Sweden you have the right to complain about a faulty or damaged product within 3 years. But you can also make a complaint if the product doesn't correspond with the information you have received or if it's not suitable for its purpose.

How to file a complaint


1. Find out about you rights

The Consumer Sales Act determines what you can demand of the company.

You have the right to complain for 3 years. However, you need to file your complaint within 2 months from when you discovered the fault. If you wait longer, you may lose your right to demand anything from the company. Do you lack the original packaging? Don't worry, you still have the right to complain.

What counts as a fault or defect?

You can complain about defects in the following cases:

  • The product being defective, functioning poorly or being broken. The product may have visible faults, such as damage during transport. A product could also have invisible faults inside the product, that cause it to function poorly or not at all.

  • If the product does not match the information provided. For example, if the product is delivered in a different colour or size or lacks a function that was included in the description.

  • The product not being suited to its purpose, such as a rain jacket that is not water resistant.

The fault or defect must be original

In order for a product to be considered faulty or defective by law, the fault or defect must be original. An original defect is such a defect that was already in the product when you bought it or received it. The defect need not present itself directly; it may involve an original defect even if the defect becomes apparent after some time.

What can you demand of the company if the product is defective?

Firstly: that you have the fault fixed or be given a new product

The fault being fixed means that the company corrects the defect, by repairing or replacing a defective part, for example.

The other alternative is that you be given another, non-defective product. If the company cannot offer the same product, it may be acceptable to receive a product that is equivalent. Equivalent means that it has the same type of characteristics as the one you purchased.

Suggest to the company yourself which solution you would prefer. However, if the company can proof that it would be an unreasonably large cost to give you a new product, compared with making repairs, they usually have the right to make the repairs.

Secondly: that you receive a price reduction

The price reduction should match the defect, such as what it costs to have the defect fixed by another company.

If the product has a cosmetic flaw that does not affect its functionality, a price reduction may be considered without correcting the flaw.

There are no set deductions. What is reasonable is determined on a case-by-case basis.

Thirdly: that you can revoke the purchase

A revocation means that the purchase is annulled, in other words that the company takes back the product and give you a refund.

If the product is sent back to the company, it is the company that must pay for shipping.

If you have already paid, you should receive the refund in the same way you paid. So, if you paid in cash or with a card, you do not have to settle for a credit note or a gift card.

Cover purchase

If the purchase has been cancelled and the consumer is thus forced to buy another product that costs more than the original one, you have the right to demand the price difference from the company. Such a cover purchase must always take place within a reasonable period of time and with a certain amount of care, inter alia, with regard to the price and quality of the item.

Usually, the company has the right to attempt to adjust the fault.

For you to be able to cancel the purchase immediately, the fault must be serious and of significant importance.

Repair time and number of repair attempts

How long may a repair take?

The company must repair the defect within a reasonable amount of time.

What a reasonable amount of time is has to be judged case by case, and depends, among other things, on what kind of defect it is and your need to have the product fixed.

If you have been offered a replacement product on temporary loan, a longer repair time may be OK.

Number of repair attempts

How many attempts the company has to try to repair the fault often needs to be determined on a case-by-case basis. It depends, among other things, on the type of fault it concerns and how much it affects you.

Normally, the company has 2 attempts to fix the same defect. But sometimes you may need to accept more attempts.

If the company has not been able to fix the fault despite several attempts? Then you may have the right to refuse further attempts and instead demand to revoke the purchase.

Revoking means that you return the item and get your money back.

When are you allowed to revoke a purchase?

In general, you cannot demand to return the product because you discovered a fault. The company you purchased it from usually should have the chance to fix the fault. To have the right to revoking the purchase, the following conditions are required:

  • The fault is significant and serious

  • The company does not fix the fault within a reasonable time

  • The company has attempted to repair the fault without success

If you believe you have the right to return the product and get a refund, you must argue for it. Contact the company in writing, for example via email. Explain why you think the purchase should be cancelled.

Deduction for use

It is not certain that you will get back the entire amount you paid if you have had a significant benefit from the product before the cancellation. The company may have the right to make a so-called deduction for usage.

There is no law specifying exactly how large the deduction for use should be. The deduction should correspond to the benefit you have had from the product. This often needs to be assessed on a case-by-case basis.

You should receive an amount that allows you to purchase an item of the same standard and condition.

Interest

You are entitled to interest for the time the company has had your money. But sometimes the company's right to a deduction for use is offset against your right to interest.

Right to withhold payment and receive compensation for expenses

When a product is defective, you have a right to withhold all or part of the payment. This means you can wait to pay until the company solves the problem.

You have the right to withhold an amount that would cover fixing the fault somewhere else.

It's important that you notify the company you are withholding payment and why.

Have you purchased the item on credit, for example through invoice or instalment? Then you need to notify both the company and the credit provider that you are withholding payment.

Remember to contact the company in writing, for example via email.

Pay under protest

You can also choose to pay under protest. This means you pay but at the same time notify the company that you are not satisfied.

This can be useful if you are unsure about your right to withhold payment. For example, if the company doesn't believe there is anything wrong with the product.

Have any costs incurred due to the defect?

You should not get any extra expenses because there is a problem with the product. The company should cover it. Examples of expenses may be:

  • Freight costs for sending the product for repair

  • Costs because you were forced to drive to the store several times

  • Loss of income if you have to stay home from work to receive a repair person

Keep in mind that it is actual costs that you can demand compensation for. You cannot demand compensation for the trouble or the time you spend on the complaint. You need to be able to present documentation, such as receipts, invoices or other certificates, on what expenses you had.

If the product causes damage

You can also demand compensation if the faulty product causes damage.

The compensation is meant to cover the damage. You should not end up in a better position than you were in before the damage occurred.

Purchases from companies within the EU, Norway, Iceland and the United Kingdom

Within the EU, Norway, Iceland and the United Kingdom, your rights when purchasing goods are largely the same, regardless of the country where the company is based.

The only difference may be the amount of time you have to complain about faults in the product.

  • Germany: 2 years

  • Ireland, England, Wales and North Ireland: 6 years

  • Scotland: 5 years

  • The Netherlands: The right to complain is based on the expected lifespan of the product, but at least 2 years.

  • Iceland and Norway: 5 years if the product you purchased has an expected lifespan longer than 2 years, otherwise 2 years.

Swedish law applies if the company targets Swedish consumers

Even if you buy something from a company in another country, you may be protected by Swedish legislation. One condition is that the company targets Swedish consumers. Examples that may indicate that the company targets Swedish consumers:

  • The company's website is in Swedish.

  • The company allows you to pay in Swedish kronor.

  • Phone number with country code for the company.

For example, if you buy something from a German company targeting Swedish consumers. Then you may have a 3-year complaint deadline (as in Sweden), even though the complaint deadline according to German legislation is 2 years.

If you have a warranty

A warranty is a promise that what you buy should function for a certain period of time.

It is voluntary for a company to provide a warranty.

The warranty can be provided by the company you purchased the product from or by, for example the manufacturer.

The company sets its own rules for the warranty. For example, they can decide how long it is valid and what is included.

Remember that you always have the right to complain about faults in goods for 3 years, even if the warranty period is shorter. For example, if you have a 2-year warranty on a product and it breaks after that? Then you can still complain about the product for another year.

2. Document the fault

When you discover faults or defects, it is important that you document what is wrong.

You need to be able to show the company what you think is wrong. The documentation is also important if you and the company do not agree on the fault.

How to document the fault

Sometimes, it is possible to show a product is defective by taking a picture or filming it.

It is important that the quality is good enough for the fault to be clearly visible. If you receive a product with an incorrect nuance of colour, you may also need to add a picture from the website that clearly shows that the nuance on the Internet is different from reality.

Search the company's website if they have any specific requirements regarding the documentation, they need from you. If you bought the product in a store, it might be easiest to show the fault there in person.

When it's not possible to document the fault

Some faults may be difficult to capture with for example pictures. In such cases, you can describe the fault when you contact the company to complain.

Sometimes the company may need to do troubleshooting to see what is causing the problem.

Has the company recommended you buy the product?

If the company has recommended you to buy a product and it turns out the item doesn't fit, then you need to show that you received incorrect information.

You might have received written information at the time of purchase, or you might be able to confirm afterward what information you received.

For example, you can try emailing the salesperson you were in contact with.


3. Write to the company

Contact the company that sold you the product

Firstly, contact the company you purchased the product from to complain about the fault. Present any claims for compensation.

Sometimes there is also a warranty on the product. It may be the manufacturer who has provided a warranty for example. In that case you may have the opportunity to contact the manufacturer directly. But according to the law, you can always make claims against the company that sold you the item.

Submit your complaint in writing

There are no requirements on how you file complaint, but we recommend that you contact the company in writing. Then you can prove that you complained and that you did so at the right time. You can send an email, for example.

Are you using a contact form? Then take a screenshot or a photo of what you write. When you contact the company to file a complaint, include following information:

  • What you bought and when you bought it

  • Description of the fault

  • Pictures or other documentation that clearly shows the fault

  • What action you want from the company

  • Documentation that shows expenses you had due to the fault

  • Receipt (if you file complain in a store)

Do you need a receipt?

There is no law that says you must present a receipt to make a complaint. It may be sufficient, for example, to show a bank statement. However, you must be able to demonstrate when you made the purchase, from whom and at what price. If you buy several items at the same time, it may not be clear from the bank statement which specific items you purchased. In that case, it may be necessary to show a receipt.

4. If you and the company can't agree

Contact an expert

To demonstrate that the fault is original, you can seek assistance from an expert. An expert could be a company that sells or repairs similar items.

It may be enough to email and ask about the expected lifespan of the item or the quality you should expect. In some cases, you may need to submit the item for examination or have someone come to your home to provide an assessment.

You will need to pay the expert for their assessment. You can later demand the company that sold you the item to reimburse you for the cost, but only if the fault is the company's responsibility.

Contact the company again

To move forward, you need to contact the company again, for example via email. Inform the company that they are responsible for fix the fault. Attach documentation that supports the claim that the fault is original.

Have you paid for an assessment? Then you can also demand that the company reimburses you for the cost simultaneously.

Also request a written response to your demands.

If the item is older than 3 years

If the item is older than 3 years, you cannot file a complaint. However, if there is still a valid warranty, you can use it.

You want a new product or your money back

Generally, you cannot demand a refund (revoking the purchase) if the company wants to repair the item. Cancelling the purchase is often seen as a last resort.

If you suggest that the company should give you a new product, the company may still have the right to repair, if it becomes unreasonably expensive to provide you with a new product compared to repairing it. This applies regardless of whether the product is brand new, or you have had it for a while.

For the company to have the right to repair, it is required that the repair can be done within a reasonable time and without cost to you.

The repair takes too long or fails

If the company unreasonably delays the repair, you may have the right to:

  • Demand a new product

  • Get your money back

  • Turn to another company to have the product repaired.

How long may it take to repair the fault

The company must repair the fault within a reasonable time. What is considered reasonable time varies from case to case. It depends, among other things, on the type of fault and your need to have it fixed. It is not uncommon for you to expect a repair time of a week or two.

If you have been offered a loan item, a longer repair time may be acceptable.

If the repair takes an unreasonably long time, you can demand to revoke the purchase. Revoking means you return the item and get your money back.

The number of repair attempts for the company

If the company fails to repair the product on the first attempt, the company has 2 attempts to fix the same issue. However, sometimes you may need to accept more attempts. If the company has been unable to fix the fault despite several attempts, you may have the right to refuse further attempts and instead demand to revoke the purchase. Revoking means you return the item and get your money back. If you cannot reach an agreement, you need to have proof that it is the same fault as before. This could be, for example, text messages or emails between you and the company or a certificate from another company. If you have no documentation, you can try contacting the company via text message or email and ask them to confirm that it has been the same fault multiple times.

Let another company repair the fault

If the company does not fix the fault within a reasonable time, you may also consider repairing the fault at another company. Contact the company you purchased the product from in writing first, for example via email. Explain that if the repair is not completed soon, you will need to turn to another company. Also notify them that you will demand compensation for the repair costs. It is important that you can demonstrate that you have complained about the repair taking too long before turning to another company. If the company confirms that they cannot repair the product within a reasonable time or does not respond to you, you can turn to another company. Remember that you will have to pay the company to repair the product. You can later demand that the company that sold you the product reimburses you for the cost.

The company believes that the product is free from defects

You always need to be able to demonstrate that there is a defect.

If the company does not agree that the product is faulty or if they have inspected the product without finding any fault, you need to prove that there is a defect. Perhaps it is a fault that only appears intermittently. Evidence of a fault may include:

  • photos

  • videos

  • an opinion from an expert of the type of product in question.

You have demanded a refund but did not receive the money

When the company has promised you a refund

If the company has stated that they will refund you, it is important that you can prove it. If you have written documentation stating that you are entitled to a refund, but the company still does not refund you, you can turn to the Enforcement Authority (Kronofogden). Through the Enforcement Authority, you can apply for a so-called payment order. It costs 300 SEK. You will pay the fee, but you can demand that the company reimburses you for the cost later. It is only when the purchase has been cancelled that you have the right to demand the money back from the company.

If you paid by card

If you paid by card, you could make a so-called card dispute. You contact your bank to see if they can assist you with a refund. You can try to make a card dispute regardless of the type of card you used. However, if you paid by credit card, you have stronger protection than if you used a regular bank card.

When you pay by credit card or invoice, according to the Consumer Credit Act, you have the right to assistance from your credit provider if you encounter problems. The law states that you can make the same demands on the credit provider as you can on the company. Contact your bank or credit provider to find out what to do.

If you are unable to seek help from your bank or credit provider and you and the company cannot reach an agreement, you can make a complaint to the Swedish Consumer Agency (ARN).

6. Have your case reviewed

Free dispute resolution through the National Board for Consumer Disputes

If you and the company cannot reach an agreement, you can make a complaint to the public authority “Allmänna reklamationsnämnden” (ARN) [The National Board for Consumer Disputes]. ARN will assess your case and provide a recommendation on how to resolve the dispute. Most companies follow ARN's recommendations. It does not cost anything to have your case reviewed by ARN. The normal processing time is approximately 6 months. In some cases, it can be quicker and in others it may take longer.

If the company has refused your demands, you can make a direct complaint. If you have not received a response from the company, you must wait for 30 days before you can make a complaint to ARN. If you complain earlier, your complaint will be rejected.

Requirements for ARN to consider your case
  • The company has either fully or partially rejected your claim or has not responded to you.

  • The amount that you and the company cannot agree on exceeds ARN's value limit.

  • You must make the complaint within 1 year of the date you first complained to the company.

Sometimes, the municipal consumer advisors can assist you in making a complaint to ARN.

Settle the dispute in court

If you have gone through the steps in this process but still have a dispute with the company, you can take the dispute to court. In that case, you should contact the district court (tingsrätten). Unlike making a complaint to ARN, it costs money to file an application with the court.

For a dispute involving a claim of up to 28,650 Swedish kronor (half a price base amount in 2024), known as a simplified litigation or small claim, the application fee is 900 kronor. If the claim exceeds 28,650 kronor, or if the dispute does not concern a specific amount, the application fee is 2,800 kronor.

If you lose the dispute, you may be required to pay both your and the company's legal costs. However, in small claims, the costs you may have to pay are limited.

1. Ta reda på dina rättigheter

Vad räknas som fel?

  • Om varan inte är anpassad efter ändamålet. Alltså om varan inte går att använda till det som den vanligtvis används för. Köper du till exempel en regnjacka som inte tål regn kan jackan ses som felaktig.

Du behöver kunna visa att du köpt varan hos det företaget. Det kan vara genom till exempel kvitto eller kontoutdrag.

Felet ska vara ursprungligt

För att varan ska ses som felaktig ska felet vara ursprungligt. Ett ursprungligt fel är ett fel som fanns redan när du köpte eller tog emot varan.

Felet behöver inte visa sig direkt. Det kan handla om ett ursprungligt fel även om felet visar sig efter viss tid.

Varan räknas inte som felaktig om du själv orsakat felet, till exempel genom att använda den på fel sätt.

Vad kan du kräva av företaget?

I första hand: att du får felet åtgärdat eller får en ny vara

Att felet åtgärdas innebär att företaget kostnadsfritt rättar till felet. De kan till exempel reparera varan eller byta ut en felaktig del.

Det andra alternativet är att du får en annan, felfri vara. Kan företaget inte erbjuda en likadan vara kan det vara okej att få en vara som är likvärdig. Med likvärdig menas att den har samma typ av egenskaper som varan du köpte.

Du kan själv föreslå vilken lösning du vill ha. Men om företaget kan visa att det blir en orimligt stor kostnad att ge dig en ny vara jämfört med att reparera, har de vanligtvis rätt att göra reparationen.

I andra hand: att du får ett prisavdrag

Prisavdraget ska motsvara felet, till exempel vad det kostar att få felet åtgärdat av ett annat företag.

Har varan ett skönhetsfel som inte påverkar funktionen kan det bli aktuellt med ett prisavdrag utan att felet åtgärdas.

Det finns inga bestämda avdrag. Vad som är rimligt avgörs från fall till fall.

I tredje hand: att du får häva köpet

En hävning betyder att företaget tar tillbaka varan och du får pengarna tillbaka.

Ska varan skickas tillbaka ska företaget stå för frakten.

Har du redan betalat ska du få tillbaka pengarna på samma sätt som du betalade. Betalade du kontant eller med kort behöver du alltså inte nöja dig med ett tillgodokvitto eller presentkort.

Täckningsköp

Hävs köpet och du tvingas köpa varan till ett högre pris hos ett annat företag, kan du kräva mellanskillnaden från det första företaget. Det kallas för att göra ett täckningsköp.

Men det måste vara fråga om en likvärdig vara och att du inte väljer det dyraste alternativet.

Den nya köpet måste göras inom rimlig tid efter att köpet hävts.

Du kan i regel inte kräva att få lämna tillbaka varan för att du upptäckt ett fel. Företaget du köpt varan av ska oftast få chansen att åtgärda felet. För att ha rätt att häva köpet krävs att

  • felet på din vara är stort och allvarligt

  • företaget inte åtgärdar felet inom skälig tid

  • företaget försökt rätta till felet utan att lyckas.

Tycker du att du har rätt att lämna tillbaka varan och få pengarna tillbaka får du argumentera för det. Kontakta företaget skriftligen, till exempel via mejl. Förklara varför du tycker att köpet ska hävas.

Nyttoavdrag

Har du haft betydande nytta av varan innan hävningen är det inte säkert att du får tillbaka hela summan du betalat. Företaget kan ha rätt att göra ett så kallat nyttoavdrag. Det finns ingen lag som säger exakt hur stort nyttoavdraget ska vara. Avdraget ska motsvara den nytta du haft av varan. Detta behöver ofta bedömas från fall till fall. Du ska få tillbaka ett belopp som gör att du kan köpa en vara i samma standard och skick.

Ränta

Du har rätt till ränta för den tid företaget haft dina pengar. Ibland kvittas företagets rätt till nyttoavdrag mot din rätt till ränta.

Så gör du med betalningen

När det är fel på varan har du rätt att hålla inne hela eller en del av betalningen. Det betyder att du kan vänta med att betala tills företaget löser problemet.

Du kan hålla inne en summa som skulle räcka till att åtgärda felet hos ett annat företag.

Det är viktigt att du meddelar företaget att du håller inne betalning och varför.

Har du köpt varan på kredit, till exempel på faktura eller avbetalning? Då behöver du meddela både företaget och kreditgivaren att du håller inne med betalningen.

Tänk på att ta kontakt skriftligen, till exempel via mejl.

Betala under protest

Du kan också välja att betala under protest. Det betyder att du betalar men samtidigt meddelar företaget att du inte är nöjd. Det kan vara bra om du är osäker på din rätt att hålla inne betalningen. Det kan till exempel vara om företaget inte tycker att det är fel på varan.

Har du fått kostnader på grund av felet?

Du ska inte få några extra kostnader för att det är fel på varan. Företaget ska stå för kostnaderna. Exempel på kostnader kan vara:

  • fraktkostnad för att skicka varan på reparation

  • kostnader för att du har tvingats köra flera gånger till butiken

  • inkomstförlust om du måste vara hemma från jobbet för att ta emot reparatör.

Du kan inte kräva ersättning för besväret eller tiden du lägger ner på att klaga på felet. För att få ersättning behöver du bevisa att det finns fel på varan och kunna visa underlag på kostnaderna. Underlag kan vara kvitton, fakturor eller andra bevis. Kostnaderna ska vara rimliga och ha direkt koppling till felet.

Om varan orsakar skador

Du kan även kräva ersättning om den felaktiga varan orsakar skador. Skadeståndet är menat att ersätta skadan. Du ska inte hamna i en bättre sits än du var i innan skadan.

Om köp från företag i annat EU-land, Norge, Island eller Storbritannien

Inom EU, Norge, Island och Storbritannien är dina rättigheter när du köper varor i stort sett likadana, oavsett vilket land företaget finns i.

Det som kan skilja sig är hur lång tid du har på dig att klaga på fel i varan.

Exempel på reklamationsfrister i andra länder
  • Tyskland: 2 år

  • Irland, England, Wales och Nordirland: 6 år

  • Skottland: 5 år

  • Nederländerna: Reklamationsrätten baseras på varans förväntade livslängd, men minst 2 år

  • Island och Norge: 5 år om varan du har köpt har en förväntad livslängd längre än 2 år, i övriga fall 2 år

På webbplatsen Ditt Europa kan du ta reda på andra länders reklamationsfrister. Ditt Europa drivs av EU-komissionen.

Även om du köper något av ett företag i ett annat land kan du vara skyddad av svensk lagstiftning. En förutsättning är att företaget riktar sig till svenska konsumenter. Exempel som kan tyda på att företaget vänder sig till svenska konsumenter:

  • Företagets webbplats är på svenska.

  • Företaget tillåter dig att betala i svenska kronor.

  • Telefonnummer med landskod till företaget.

Köper du till exempel något av ett tyskt företag som vänder sig till svenska konsumenter? Då kan du ha 3 års reklamationsfrist (som i Sverige), trots att reklamationsfristen enligt tysk lagstiftning är 2 år.

Om du har en garanti

En garanti är ett löfte att det du köper ska fungera under en viss tid. Det är frivilligt för ett företag att lämna en garanti. Garantin kan lämnas av företaget du köpt varan av eller av till exempel tillverkaren. Företaget bestämmer självt reglerna för garantin. De kan till exempel bestämma hur länge den gäller och vad som ingår. Kom ihåg att du alltid har rätt att reklamera fel på varor i 3 år, även om garantitiden är kortare. Har du till exempel en garanti på en vara i 2 år och varan går sönder efter det? Då kan du reklamera varan i ett år till. Mer om garanti


2. Dokumentera felet

Det är viktigt att dokumentera när du upptäcker fel eller brister. Du behöver kunna visa för företaget vad du tycker är fel. Dokumentationen blir även viktig om du och företaget inte kommer överens. Spara därför allt underlag.

Så kan du dokumentera

Du kan till exempel fota eller filma felet. Kvaliteten behöver vara så bra att felet syns tydligt. Ibland kan det vara svårare att visa felet. Får du till exempel en vara i fel nyans kan det vara svårt att visa felet bara genom en bild. Då kan du till exempel även skicka med en bild från webbplatsen som tydligt visar att nyansen där är en annan. Läs gärna på företagets webbplats om de har önskemål kring vilket underlag de behöver från dig. Har du köpt varan i en butik kan det vara lättast att visa felet i butiken.

Går felet inte att dokumentera?

Vissa fel kan vara svåra att visa med hjälp av till exempel bilder. Finns det inget bra sätt att dokumentera felet? Då kan du beskriva felet när du kontaktar företaget för att klaga. Ibland kan företaget behöva göra en felundersökning.

Har företaget rekommenderat dig att köpa varan?

Har företaget rekommenderat vilken vara du ska köpa, och det visar sig att varan inte passar? Då behöver du visa att du fick felaktig information. Du kanske fick skriftlig information i samband med köpet, eller så kanske du i efterhand kan få bekräftat vilken information du fick. Du kan till exempel prova att mejla säljaren du var i kontakt med.


3. Skriv till företaget

Vänd dig till företaget som sålde varan till dig

Kontakta i första hand företaget du köpte varan av för att klaga på felet. Framför eventuella krav på ersättning. Ibland finns det även garanti på varan. Det kan till exempel vara tillverkaren som lämnat en garanti. Då kan du ha möjlighet att vända dig direkt till tillverkaren. Men enligt lag kan du alltid ställa krav mot företaget som sålde varan till dig.

Reklamera skriftligen

Det finns inga krav på hur du ska klaga på felet. Men det är bra att kontakta företaget skriftligen. Du kan till exempel skicka ett mejl. Då kan du bevisa att du klagat och när du gjort det. Spara mejlet som bevis. Använder du ett kontaktformulär? Då bör du ta en skärmbild eller fota det du skriver. När du kontaktar företaget är det bra att ta med följande uppgifter:

  • vad du köpt och när du gjorde köpet

  • en beskrivning av felet

  • bilder eller annat underlag som tydligt visar felet

  • vilken åtgärd du önskar av företaget

  • underlag som visar kostnader du fått på grund av felet

  • kvitto (om du reklamerar i butik)

Måste du ha kvitto?

Det finns ingen lag som säger att du måste visa ett kvitto för att reklamera. Det kan gå bra att till exempel visa ett kontoutdrag. Men du måste kunna visa när du gjorde köpet, av vem och till vilket pris. Köper du flera varor vid samma tillfälle är det inte säkert att kontoutdraget visar vilka specifika varor du köpt. Då kan det vara nödvändigt att visa ett kvitto.


Om det inte löser sig


4. Om du och företaget inte kommer överens

Företaget menar att det är ett fel de inte behöver ta ansvar för och du har ingen garanti

Enligt konsumentköplagen har du rätt att klaga på fel i 3 år från köpet. Det gäller även om varan saknar garanti eller garantin gått ut. Är felet ett ursprungligt fel kan du kräva att företaget lagar eller byter ut varan.

Fel som uppstår under de första 2 åren ses automatiskt som fel företaget ska åtgärda. Det brukar kallas för att bevisbördan ligger hos företaget. Det räcker att du kan visa att det finns fel. Du behöver inte kunna bevisa vad felet beror på. Företaget måste kunna visa att felet beror på dig eller att felet är normalt med tanke på varans skick för att slippa ansvar.

När det har gått mer än 2 år från köpet behöver du kunna visa att felet fanns i varan redan när du köpte den.

Kontakta en sakkunnig

För att visa att felet är ursprungligt kan du ta hjälp av en sakkunnig. En sakkunnig kan till exempel vara ett företag som säljer eller reparerar liknande varor. Det kan räcka med att mejla och fråga hur lång tid varan förväntas hålla eller vilken kvalitet du bör kunna räkna med. I vissa fall behöver du lämna in varan eller be någon att komma hem till dig för att få ett utlåtande. Du behöver betala den du anlitar för ett utlåtande. Du kan i efterhand kräva att företaget som sålde varan till dig ersätter dig för kostnaden, men bara om felet är företagets ansvar.

Kontakta företaget igen

För att komma vidare behöver du kontakta företaget igen, till exempel via mejl. Informera företaget om att de ansvarar för att åtgärda felet. Bifoga underlag som styrker att felet är ursprungligt. Har du betalat för ett utlåtande? Då kan du samtidigt kräva att företaget ersätter dig för kostnaden. Begär också ett skriftligt svar på dina krav.

Om varan är äldre än tre år

Är varan äldre än 3 år kan du inte reklamera den. Men om det finns en garanti som fortfarande gäller kan du använda den.

Du vill ha en ny vara eller pengarna tillbaka

Du kan i regel inte kräva att få pengarna tillbaka (häva köpet) om företaget vill reparera varan. Hävning ses ofta som en sista utväg. Om du föreslår att företaget ska ge dig en ny vara, kan företaget ändå ha rätt att reparera varan om det blir orimligt dyrt att ge dig en ny vara i förhållande till att reparera varan. Det gäller oavsett om varan är helt ny eller du haft den ett tag. För att företaget ska ha rätt att reparera varan krävs det att reparationen kan göras inom rimlig tid och utan kostnad för dig.

Reparationen drar ut på tiden eller misslyckas

Dröjer företaget orimligt länge med reparationen kan du ha rätt att:

  • kräva en ny vara

  • få pengarna tillbaka

  • vända dig till ett annat företag för att få varan lagad.

Hur lång tid får en reparation ta?

Företaget ska reparera felet inom skälig tid. Vad som är skälig tid bedöms från fall till fall. Det beror bland annat på vilken typ av fel det är och ditt behov av att få varan lagad. Det är inte ovanligt att du får räkna med någon eller några veckors reparationstid. Om du har blivit erbjuden en lånevara kan en längre reparationstid vara okej. Om reparationen tar oskäligt lång tid kan du kräva att få häva köpet. Då lämnar du tillbaka varan och får pengarna tillbaka.

Så många reparationsförsök har företaget på sig

Lyckas inte företaget laga varan på första försöket? Normalt sett har företaget två försök på sig att åtgärda samma fel. Men ibland kan du behöva acceptera fler försök. Har företaget inte kunnat laga felet trots flera försök kan du ha rätt att säga nej till ytterligare försök och istället kräva att få häva köpet. Häva betyder att du lämnar tillbaka varan och får pengarna tillbaka. Kommer ni inte överens behöver du ha bevis på att det rör sig om samma fel som tidigare. Det kan till exempel vara sms eller mejl mellan dig och företaget eller ett intyg från ett annat företag. Har du inget underlag kan du prova att kontakta företaget via sms eller mejl för att få bekräftat att det har varit samma fel flera gånger.

Åtgärda felet hos ett annat företag

Om företaget inte lagar felet inom skälig tid kan du också överväga att laga felet hos ett annat företag. Kontakta först företaget skriftligen, till exempel via mejl. Förklara att du behöver vända dig till ett annat företag om reparationen inte är klar inom kort. Meddela också att du kommer kräva ersättning för reparationskostnaden. Det är viktigt att du kan visa att du klagat på att reparationen tar för lång tid innan du vänder dig till ett annat företag. Om företaget bekräftar att de inte kan reparera varan inom skälig tid eller inte svarar dig, kan du vända dig till ett annat företag. Tänk på att du måste betala företaget som ska reparera varan. Du får i efterhand kräva att företaget som sålde varan till dig ersätter dig för kostnaden.

Företaget tycker att varan är felfri

Du behöver alltid kunna visa att det finns ett fel. Håller företaget inte med om att varan är felaktig eller om de undersökt varan utan att hitta något fel behöver du bevisa att det finns ett fel. Kanske rör det sig om ett fel som bara visar sig ibland. Underlag som visar felet kan vara:

  • bilder

  • filmer

  • utlåtande från någon som är kunnig på den typ av vara det gäller.

Har du bevis på att varan är felaktig men företaget fortsatt säger nej kan du läsa vidare under "Om du vill få ärendet prövat".

Du har krävt återbetalning men får inte tillbaka pengarna

För att få tillbaka pengarna finns olika vägar att gå. Det beror på om företaget lovat att du ska få återbetalning eller inte, och på vilket sätt du betalade för varan.

När företaget lovat dig återbetalning

Har företaget sagt att de ska återbetala dig är det viktigt att du kan visa det. Har du skriftligt underlag på att du ska få en återbetalning, men företaget ändå inte återbetalar dig, kan du vända dig till Kronofogden. Via Kronofogden kan du ansöka om ett så kallat betalningsföreläggande. Det kostar 300 kronor. Du får betala avgiften, men du kan kräva att företaget ersätter dig för kostnaden i efterhand. Du har krävt återbetalning men företaget säger nej

Det är först när köpet är hävt som du har rätt att kräva tillbaka pengarna från företaget.

Om du betalat med kort

Har du betalat med kort kan du göra en så kallad kortreklamation. Då kontaktar du din bank för att se om de kan hjälpa dig med en återbetalning. Du kan prova att göra en kortreklamation oavsett vilken typ av kort du använt. Men har du betalat med kreditkort har du ett starkare skydd än om du använt ett vanligt bankkort. Om du har betalat med kreditkort eller faktura

När du betalar med kreditkort eller mot faktura har du enligt konsumentkreditlagen rätt att få hjälp av din kreditgivare om du stöter på problem. Lagen säger att du kan ställa samma krav mot kreditgivaren som du kan göra mot företaget. Det innebär att du kan kräva återbetalning från kreditgivaren, till exempel banken eller fakturaföretaget, om företaget inte återbetalar dig. Det kallas att använda invändningsrätten. Om du betalat på annat sätt

Om du inte kan ta hjälp av din bank eller kreditgivare och du och företaget inte kommer överens kan du ha möjlighet att få ärendet prövat genom att göra en anmälan till myndigheten Allmänna reklamationsnämnden (ARN).

Företag inom annat EU-land, Norge, Island eller Storbritannien

Om du är bosatt i Sverige och företaget du har problem med är registrerat i ett annat land inom EU, Norge, Island eller Storbritannien kan du få kostnadsfri rådgivning av Konsument Europa.   • Ditt förnamn och efternamn och namnet på företaget du har handlat av

  • En beskrivning av problemet och hur du vill att företaget ska lösa det

  • Datum då du gjorde beställningen och datum då du tog emot den

  • Priset på varan/tjänsten och hur du betalade

  • Dokumentation som bevisning av ditt ärende

Exempel på dokumentation
  • Avtal/avtalsvillkor

  • Skärmdumpar på annonser

  • Faktura/kvitton på köp

  • Reklamation eller ångerrättsmeddelande

När du skickat in ditt ärende får du oftast svar inom ungefär en månad.

Konsument Europa kan INTE:
  • Tvinga ett företag att agera enligt lag. Arbetet bygger på att företaget är villigt att samarbeta med ECC-nätverket för att nå en lösning.

  • Medla i ett ärende om vi inte kan identifiera säljaren eller där säljaren vägrar samarbeta med ECC-nätverket.

  • Agera som juridiskt ombud eller hjälpa till när konsumenten redan har inlett ett rättsligt förfarande.

  • Hjälpa till vid köp mellan näringsidkare eller köp mellan privatpersoner.

6. Om du vill få ärendet prövat

Kostnadsfri tvistlösning via Allmänna reklamationsnämnden

Om du och företaget inte kommer överens kan du göra en anmälan till myndigheten Allmänna reklamationsnämnden (ARN). ARN bedömer ditt ärende och lämnar en rekommendation om hur tvisten ska lösas. De flesta företag följer ARN:s rekommendationer. Det kostar inget att få ditt ärende prövat av ARN. En normal handläggningstid är cirka 6 månader. I vissa fall kan det gå fortare, och i andra fall tar det längre tid. Har företaget sagt nej till dina krav kan du anmäla direkt. Om du inte fått svar från företaget behöver det ha gått 30 dagar innan du kan anmäla till ARN. Om du anmäler tidigare kommer din anmälan att avslås.

Krav för att ARN ska kunna pröva ditt ärende
  • Företaget har sagt helt eller delvis nej, eller inte svarat dig.

  • Summan som du och företaget inte kommer överens om överstiger ARNs värdegräns.

  • Du måste anmäla inom ett år från det att du klagade till företaget första gången. Gör en anmälan på ARN:s webbplats

Om du behöver hjälp med din anmälan

Ibland kan kommunens konsumentvägledare hjälpa dig att göra en anmälan till ARN.

Pröva tvisten i domstol

Om du gått igenom stegen i den här processen men fortfarande har en tvist med företaget, kan du ta tvisten till domstol. Då vänder du dig till tingsrätten. Till skillnad från att anmäla till ARN kostar det pengar att lämna in en ansökan till domstol. Är du osäker på om du ska vända dig till domstol eller behöver hjälp med att driva ditt fall, kan du ta hjälp av en jurist. När du funderar på att anlita juridisk hjälp kan du först kontakta ditt försäkringsbolag. I många hemförsäkringar finns ett så kallat rättsskydd. Det betyder att försäkringen kan täcka vissa kostnader i samband med juridiska processer.

Vad kostar det?

För en tvist som rör ett krav under 28 650 kronor (ett halvt prisbasbelopp år 2024), ett så kallat förenklat tvistemål eller småmål, är ansökningsavgiften 900 kronor. Om kravet är över 28 650 kronor, eller om tvisten inte rör något bestämt belopp, är ansökningsavgiften 2 800 kronor. Om du förlorar tvisten kan du bli tvungen att betala både dina och företagets rättegångskostnader. Men i småmål är kostnaderna du kan tvingas betala begränsade.
